Our favorite Gossip Girl mom apparently isn't getting any rest during her maternity leave. Kelly Rutherford has been granted a temporary restraining order against ex-husband and father of her two children, Daniel Giersch.

Kelly Rutherford's real-life divorce continues to be more dramatic than anything the Gossip Girl writers could have come up with.

Rutherford, whose been battling her estranged husband, Daniel Giersch, for months over custody, has filed papers stating that she fears that Giersch will leave the country with their two children, Hermes and Helena.

Giersch, who's from Germany originally, and Rutherford have both had to give up their visas and passports until the custody battle is over.

Kelly Rutherford, aka Lily van der Woodsen-Bass, of CW's Gossip Girl welcomed a baby girl, Grace Rutherford Giersch, on Monday night.

Her estranged husband, Daniel Giersch, was reportedly invited to the hospital, but was a no-show.

This is getting more drawn out and messy than a Gossip Girl storyline.

Kally Rutherford's inamicable divorce from Daniel Giersch continued to get more hostile this week as Rutherford filed papers meant to prevent Giersch from bringing their 2 year old son, Hermes, into his home.

Rutherford claims he is putting their child in danger by not properly securing the pool and play areas of his house.

The two are due in court this Friday to settle the matter.

Kelly Rutherford's real-life divorce is starting to sound eerily like the life of her on-screen Gossip Girl alter-ego, Lily van der Woodsen.

While Lily was being assaulted in a bathroom and making adoption and paternity deals on this week's episode of GG, Rutherford was filing very real papers in court against her estranged husband, Daniel Giersch, ahead of their divorce hearing scheduled for today.

F. Gary Gray's latest effort, Law Abiding Citizen, starring Jamie Foxx and Gerard Butler, is a knockout! Exhilirating, wry and breathcatchingly paced, it's a stellar accomplishment for everyone involved. Hell yeah you should see it!
